2. Scope of our services; what this site is not

Accestura LLC provides business-to-business professional services: assessment, architecture design, configuration of client environments, identity policy, session oversight, monitoring, reporting and staff enablement. Our work is advisory and operational, and it is performed inside environments owned and controlled by our clients.

This website distributes no product, package or file. We sell nothing for acquisition or execution on a visitor’s device, and nothing on this site is offered for copying, obtaining or running on your equipment. Any reference to services, capabilities or deliverables describes professional engagements only. Communications through this website, including form submissions, do not create a client relationship; an engagement exists only under a signed master services agreement and statement of work.

4. Intellectual property

The text, structure, design and code of this website are owned by Accestura LLC and protected by applicable law. You may view and print pages for your own internal evaluation. Our methodologies, templates, models and know-how remain our property. Ownership of configurations, documents and artefacts produced during a paid engagement is governed by the statement of work, which normally assigns them to the client.

6. Confidentiality

Each party will protect the other’s confidential information with at least the care it uses for its own and will use it only to perform the agreement. Confidential information does not include material that is public through no fault of the receiving party, was already known to it, or is independently developed. This obligation survives termination.

8. Limitation of liability

To the fullest extent permitted by law, Accestura LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to this website. Our total aggregate liability arising from or related to this website will not exceed the total fees paid by you to us in the twelve months preceding the event giving rise to the claim. Liability arising under a signed engagement is governed by the liability provisions of that agreement.

10. Governing law and binding arbitration

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Except where prohibited by law, any dispute arising from or relating to these Terms or this website will be resolved by binding individual arbitration seated in Atlanta, Georgia, under the rules of a recognized arbitration association, before a single arbitrator. Each party waives any right to have a dispute decided by a jury.

Class action waiver. To the fullest extent permitted by law, you and Accestura LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective or representative proceeding. The arbitrator may not consolidate more than one person’s claims without the consent of all parties. If this waiver is found unenforceable as to a particular claim, that claim must proceed in court and the remainder stays in arbitration.

Nothing in this section prevents either party from seeking relief in a court of competent jurisdiction to protect its intellectual property or confidential information.
